1. Acceptance of Terms

By accessing or using Bookbite AI (the "Platform"), operated by FLONUT SRL ("Company," "we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the Platform. By creating an account, you confirm that you have read, understood, and accepted these Terms in their entirety.

2. Description of Service

Bookbite AI is an AI-powered platform that enables users to create personalized children's books. The Platform uses artificial intelligence to generate text content and illustrations based on user input, producing digital and print-ready books. Each book contains 28 pages of AI-generated content.

3. Intellectual Property and Copyright

3.1 Ownership of AI-Generated Content. All materials produced by the Bookbite AI platform, including but not limited to text, illustrations, images, page layouts, book covers, and any other creative output generated through the use of our AI tools (collectively, "Generated Content"), are the exclusive intellectual property of FLONUT SRL / Bookbite AI. By using the Platform, you acknowledge and agree that Bookbite AI retains full copyright and ownership of all Generated Content.

3.2 License to Users. Upon purchase of a book (digital download or hardcover), Bookbite AI grants you a limited, non-exclusive, non-transferable, personal license to use, display, and share the Generated Content for personal, non-commercial purposes. This license does not transfer ownership or copyright of the Generated Content to you.

3.3 Restrictions. You may not: (a) claim authorship or copyright over any Generated Content; (b) sell, license, sublicense, or commercially distribute any Generated Content; (c) use Generated Content to train other AI models or machine learning systems; (d) remove or alter any copyright notices or attributions; (e) use Generated Content in any way that competes with or is detrimental to Bookbite AI.

3.4 User Input. You retain ownership of any original text, names, descriptions, or other input you provide to the Platform ("User Input"). However, you grant FLONUT SRL / Bookbite AI a worldwide, irrevocable, royalty-free, perpetual license to use, store, modify, reproduce, and process your User Input for any purpose, including but not limited to generating content, improving our services, training AI models, research, analytics, and any other use at our sole discretion.

3.5 Portfolio and Marketing Rights. Bookbite AI reserves the right to use any Generated Content in its portfolio, marketing materials, social media, and promotional activities without prior notice or consent.

3.6 No Expectation of Data Usage. By using the Platform, you acknowledge and agree that you have no expectation, right, or claim regarding how FLONUT SRL / Bookbite AI uses, processes, stores, or shares any data you provide or any content generated through the Platform. We reserve the right to use any and all data, prompts, outputs, and Generated Content for any lawful purpose at our sole discretion.

4. AI Models and Technology

4.1 Choice of AI Models. Bookbite AI reserves the unrestricted right to use, switch between, combine, or replace any AI model, machine learning system, or technology provider at any time and without notice. We make no guarantees as to which specific AI model or technology will be used to generate content. Users shall have no expectation or claim regarding the specific technology used.

4.2 Data Processing by Third Parties. User Input and associated data may be processed by third-party AI providers as part of content generation. By using the Platform, you consent to such processing and acknowledge that different AI providers may have different data handling practices.

5. Data Storage and Prompts

5.1 What We Store. Bookbite AI stores all data you provide and all output generated through the Platform, including but not limited to: user input (text prompts, character descriptions, story settings), all generated text and image prompts, all AI-generated illustrations and text content, metadata and timestamps associated with your activity.

5.2 No Biometric Data. The Platform does not collect, process, or store biometric data. User inputs such as character descriptions, names, physical descriptions, and personality traits are creative inputs only and do not constitute biometric data under any applicable law. Any resemblance between fictional characters and real individuals is coincidental.

5.3 Unlimited Data Use. You acknowledge and agree that all data, prompts, and outputs stored by Bookbite AI may be used by FLONUT SRL for any lawful purpose, including but not limited to improving AI models, analytics, research, marketing, and any commercial purpose, without additional notice, consent, or compensation.

6. Free and Paid Services

6.1 Free Preview. Users may create and preview up to two (2) books at no cost. Free previews allow you to view the full book but do not include download or print capabilities.

6.2 Purchases. To download a digital PDF or order a hardcover copy, payment is required. All prices are displayed in the currency appropriate to your location (EUR, USD, or RON). Prices are subject to change without notice.

6.3 No Subscriptions. Bookbite AI operates on a pay-per-book model. There are no recurring subscription fees.

7. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are solely responsible for all activity that occurs under your account.

8. Content Guidelines

You agree not to use the Platform to create content that is: (a) offensive, hateful, discriminatory, or violent; (b) sexually explicit or inappropriate for children; (c) defamatory or libelous; (d) infringing on any third-party intellectual property rights; (e) in violation of any applicable law or regulation. Bookbite AI reserves the right to filter, reject, or remove any content that violates these guidelines.

9. Disclaimer of Warranties and Liability

9.1 Bookbite AI is provided "as is" and "as available" without warranties of any kind, whether express or implied. FLONUT SRL disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

9.2 To the maximum extent permitted by law, FLONUT SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Our total liability shall not exceed the amount you paid for the specific product giving rise to the claim.

9.3 We make no guarantees regarding the quality, accuracy, appropriateness, or suitability of any AI-generated content. Users accept all AI-generated content at their own risk.

10. Refund Policy

Due to the digital nature of our products and the cost of AI generation, all sales are final. However, if you experience a technical issue that prevents you from accessing your purchased content, please contact us and we will work to resolve the issue or provide a refund at our discretion.

11. Termination

FLONUT SRL / Bookbite AI reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Platform ceases immediately. All provisions regarding intellectual property, data usage, limitation of liability, and governing law shall survive termination.

12. Modifications to Terms

FLONUT SRL may update these Terms at any time without prior notice. We will post the updated Terms on the Platform with a revised "Last updated" date. Your continued use of the Platform after changes are posted constitutes your irrevocable acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Romania.
